PLANNING LAW FACT SHEETS

EDO Qld has produced a series of detailed fact sheets designed to provide the community with plain English explanations of the environmental law in Queensland. Please note that the fact sheets address Queensland law specifically and do not apply to other States.

Please note that the Sustainable Planning Act 2009 is due to commence on 18 December 2009. When development applications were lodged before 18 December 2009 the IPA factsheets, below,  are still relevant. Where planning scheme changes were started before 18 December 2009 eg advertising of a “Statement of proposals” the factsheets are still relevant. However if your inquiry deals with development applications lodged on or after 18 December 2009, please ring EDO to check the law until we have revised the factsheets to reflect the Sustainable Planning Act.

The IPA is Queensland's most important planning and land use legislation, that sets out the process for when and how development can occur. (revised September 07)

This fact sheet explores the concept of ecological sustainability, details how it is defined in the IPA, and how the purpose provisions might be used to achieve better planning. (revised September 07)

This fact sheet describes what is meant by ‘planning instruments’ under the IPA. It also deals with the preparation of planning schemes as the most significant of the four planning instruments available under the IPA. (revised September 07)

  • Factsheet 4 - The South East Regional Plan and the new planning regime

This fact sheet is being prepared.

This fact sheet discusses how to make effective submissions on the preparation and amendment of planning schemes, statements of proposals, and planning scheme policies under the IPA. (revised September 07)

This factsheet describes the development assessment process under the Integrated Planning Act 1997 (“IPA”). (revised September 07)

This fact sheet describes how to make an effective submission on a development application under the Integrated Planning Act 1997. (revised September 07)

This fact sheet details your rights to information on planning processes and development applications under the IPA.

The main avenue for reviewing and appealing decisions under the Integrated Planning Act 1997 (IPA) is the Planning and Environment Court . This factsheet discusses the role, powers and processes of the Planning and Environment Court . (revised September 07)

This fact sheet outlines the significance of environmental impact assessment in Queensland, and when it will be required. (revised September 07)

This fact sheet gives an overview of the structure and operations of local government to aid community groups trying to make use of the IPA.
