1. EDO position vacancy: Education Officer
The EDO is seeking to employ an Education Officer (part-time) to assist in the delivery of the EDO 's Community Legal Education Program and Rural and Regional Program for three days per week. The Education Officer also assists in the delivery of additional strategic projects, as identified from time to time.
The Community Legal Education and Rural and Regional Programs:
- conduct community workshops to enable practical participation in environmental decisions;
- conduct seminars and conferences on key issues to promote law reform and the implementation of new laws;
- produce plain English educational materials in a range of formats, explaining environmental law and policy;
- conduct outreach activities, and promote the services of the EDO, to rural and regional communities; and
- develop and maintain links with rural and regional communities.
SELECTION CRITERIA
The position is open to dynamic, self-motivated candidates who satisfy the following selection criteria:
Essential
- a NSW practicing certificate, or eligibility for admission to legal practice in NSW
- an excellent understanding of NSW and Commonwealth environmental law and policy
- excellent written and oral communication skills, with a proven ability to speak in public
- ability to work collaboratively with a small team
- commitment to the protection of the environment and community participation in environmental decision-making.
Desirable
- tertiary qualifications and/or experience in a related field, such as in adult or community education, or communications
- capacity to liaise effectively with a wide range of stakeholders
- current drivers licence
- willingness to travel
- flexibility in working hours
- experience in desktop design
Salary Range: $50,000-$63,000 pro rata (plus super), depending on experience

2. EDO seeking second hand computers
The Environmental Defender's Office NSW is seeking second hand computers for the use of its volunteers. The EDO 's volunteer program is crucial to the work of the office and continues to expand. To meet this demand and to enable the office to function more effectively, we would like to update the existing volunteer computers. Computers offered should be no more than three years old and have the basic Microsoft Office programs installed.

3. EDO NSW position vacancy: Scientific Officer
The EDO is seeking to employ an in-house Scientific Officer to join our Sydney office.
The Scientific Officer will provide objective scientific and technical advice to the community on public interest environmental issues and administer the EDO 's Scientific Advisory Service. The Officer will also contribute actively to policy and community legal education work within the EDO. The job involves facilitating and enhancing community involvement in environmental decision making. We are therefore seeking someone who sees value in public participation, and has an interest in Environmental Impact Assessment. The role does not involve campaigning or lobbying.
Essential criteria
- a degree in science, natural resource management, or a related discipline
- at least 2 years professional experience
- a demonstrated commitment to environmental protection
- a demonstrated ability to identify and analyse issues
- excellent research skills
- excellent written and oral communications skills
- the ability to work as part of a team

4. Invitation for Private Conservation landholders
The EDO is seeking to consult with landholders who have been involved in private conservation. The EDO is also interested in speaking with people who are in the process of investigating or carrying out private conservation or people who have looked at private conservation options and decided against implementing a private conservation program. If you fit into any of these categories please contact us. Your feedback and experiences will be used as part of the research into a new free publication on private conservation which is due out later in the year.

5. FREE copies of the new edition of the Rural Landholder's Guide to Environmental Law in NSW
The new edition of the Rural Landholder's Guide to Environmental Law in NSW, a publication last produced by the EDO in 2006, is now available for free, including postage and handling. The guide is a valuable tool in understanding the law in NSW regarding land management and explains legislation dealing with issues such as vegetation management, protected species, fire management, water management, construction and development, pollution, agricultural chemicals, crops and stock, mining and quarrying, heritage protection, conservation on private land and trading and offsetting agreements.

6. Successful Native Title claim: Kuuku Ya'u People v State of Queensland
Justice Andrew Greenwood of the Federal Court ended a 14-year battle over ancient land and sea rights in far north Queensland when he recognised the Kuuku Ya'u people's claim over a remote beach and ocean waters at Portland Roads 850km north of Cairns last Thursday. The determination grants the Kuuku Ya'u exclusive native title rights to enjoy over 10 square kilometres of the claimed land area and non-exclusive rights over 1,970 square kilometres of the sea. Three indigenous land use agreements, with the State government, the Great barrier Reef Marine Park Authority and Cook Shire Council grew out of the claim. A Kuuku Ya'u elder said the ruling recognises her people's deep and ancient bond with the area.

7. Federal Court access to justice reforms
The Federal Government has recently introduced legislation into Parliament that aims to reduce the cost of litigation and minimise unnecessary court delays in the Federal Court. The Access to Justice (Civil Litigation Reforms) Amendment Bill 2009 introduces targeted reforms to ensure people are able to resolve their disputes quickly, effectively and fairly. The Bill's key reforms include:
- introducing an overarching obligation to facilitate the just resolution of disputes as quickly, inexpensively and efficiently as possible;
- providing powers to impose cost penalties on parties and their lawyers who fail to comply with this duty;
- clarifying directions the Court can make to control the progress and conduct of legal proceedings; and
- streamlining appeal pathways to reduce confusion for litigants and ensure the best management of Court resources.

8. NSW Solar feed-in tariff
The NSW Government has introduced a solar feed-in tariff scheme. This means that households with solar panels will now be paid for any excess electricity they generate and which is pumped back into the grid. Under the 20-year plan residents, plus some schools, small businesses and community groups will be paid 60 cents per kilowatt hour that they feed into the grid - four times the average cost of electricity. The scheme will begin 1 January 2010 and apply to solar systems up to 10 kilowatts in size.

9. Cultural fishing in NSW
The NSW Department of Primary Industries has released a discussion paper, titled 'Cultural Fishing in NSW'. The Government seeks feedback from Aboriginal people and communities on the provisions of the Fisheries Management Act 1994 that allow Aboriginal people to take fish outside the rules of commercial and recreational fishing to satisfy cultural needs. Consultation meetings have also been proposed. Advice from submissions and the consultations will be used to formulate the revised guidelines for cultural fishing in NSW.

10. Water Market Rules and Water Charge (Termination Fees) Rules commence
The Water Market Rules 2009 and Water Charge (Termination Fees) Rules 2009 have now come into effect, being registered under Water Act 2007. In NSW and South Australia irrigation infrastructure operators typically hold water on behalf of irrigators and may prevent them from selling their water rights. However, the water market rules allow irrigators to 'transform' their irrigation rights into a statutory water access entitlement directly held by the irrigator, and as a result the irrigation infrastructure operator can no longer prevent them from selling their water.
To assist irrigators and infrastructure operators understand the new arrangements, the Australian Competition and Consumer Commission has issued two guides:
- Permanently selling your water and terminating your delivery right - a guide for irrigators about the water market rules and rules on termination fees
- Transforming your irrigation right and maintaining water delivery - a guide for irrigators about the water market rules

11. Draft Western Councils Sub Regional Land Use Strategy exhibition
The draft Western Councils Sub Regional Land Use Strategy is a planning instrument from a collaboration between the NSW Department of Planning and the Councils of Narromine, Warren, Bogan, Gilgandra and Coonamble. It is the third major document in a series leading towards the preparation of a new Local Environmental Plan for each of the Local Government Areas. The strategy explains what each Council wishes to achieve in relation to key planning issues and how this might be achieved.
The draft Strategy will be on public exhibition from Monday 1 June to Friday 3 July 2009, at the Council's chambers and available on each Council's website. Comments are invited until 3 July 2009.

12. New conservation reserve for Western Sydney
The 181 hectare former Air Services Australia site at Cranebrook has recently been declared a part of the public reserve system to form a new conservation reserve in Sydney 's west. The decision by the NSW and Commonwealth governments will protect some of Sydney 's most endangered species, provide a critical wildlife corridor and secure additional green space for the residents of Sydney 's west.

13. Private Member's Bills of interest in NSW Parliament
Game and Feral Animal Control Amendment Bill 2009
NSW Parliament has rejected the Game and Feral Animal Control Amendment Bill in its entirety. The Shooters Party sought to have the Bill passed, allowing recreational hunting to take place in National Parks, including the hunting of 26 native species and the release of exotic birds for hunting purposes. The Bill had raised significant concerns amongst environmental conservation groups but for the moment will not be passed.

Mining Amendment (Safeguarding Agricultural Land and Water) Bill 2009
The Greens introduced the Mining Amendment ( Safeguarding Agricultural Land and Water) Bill 2009 to protect prime agricultural land (and water sources that feed prime agricultural land) from mining operations. The Bill has now been rejected.

14. Independent Review of the National Environmental Protection Law
On 29 June 2009, the Australian Government was presented with an interim report as part of the independent review of the Environment Protection and Biodiversity Conservation Act 1999, Australia 's central piece of federal environmental law. The report pulls together the key issues raised through public submissions and consultations to date and aims to stimulate discussion and identify gaps in the law.

15. International: US passes Energy and Climate Bill
The US House of Representatives recently passed the American Clean Energy and Security Act, the first time a US Chamber of Congress has passed a Bill that sets mandatory limits on greenhouse emissions. The majority of environmental groups in the US have hailed the legislation as an important step forward in addressing climate change and shifting the country to a clean energy economy. Despite many weaknesses in the Bill, the legislation sets forth a set of goals America must achieve and puts the country on a path to reduce carbon emissions by up to 80 percent by 2050.

Consultation on the National Parks and Wildlife Amendment Bill
The NSW Department of Environment and Climate Change is consulting on a range of proposed amendments to the National Parks and Wildlife Act 1974 and Threatened Species Conservation Act 1995. 17. Legislative Reviews
Legislation in NSW is usually reviewed after five years. A review is carried out to determine whether the policy objectives of an Act remain valid and whether the means of addressing these objectives are appropriate. The following Acts are shortly due for review:
- Native Vegetation Act 2003,
- Natural Resources Commission Act 2003,
- Catchment Management Authorities Act 2003, and
- Threatened Species Conservation Act 1995.

18. Sydney Morning Herald: Labor knew about toxic water threat (19 June 2009)
This article claims that the NSW State Government was aware of toxic pollution levels in the Coxs River near Lithgow, allegedly contaminated by outfall from the Wallerawang power station. Water tests taken from the river reveal high levels of heavy metals including copper, boron, aluminium and arsenic. The EDO is representing the Blue Mountains Conservation Society in proceedings against the power station operator, Delta Electricity.

19. Sydney Morning Herald: Bush bashing: rally laws override locals (25 June 2009)
This article reports on the new laws passed through NSW Parliament to enable France 's International Automobile Federation (FIA) to stage five rounds of its rally championships anywhere in NSW. The first scheduled event is to be held on the North Coast in the Tweed and Kyogle Shire areas and residents are concerned about the environmental impacts the event is likely to cause. The EDO Northern Rivers have been providing advice and assistance to the two resident action groups opposing the rally.

20. Sydney Morning Herald: Forestry review calls for tougher sanctions against loggers (30 June 2009)
This article refers to the findings of an interim report on Australia 's national environment laws regarding forestry agreements and their alleged failure to protect Australian forests from logging activities. 21. Newcastle Herald: No retrospective on $300m plans (19 June 2009)
This article follows the planning controversy surrounding the proposed development of Catherine Hill Bay. It reports that the Planning Minister Kristina Keneally has revealed that she has no intention of introducing retrospective legislation to ensure the $300 million residential development proceeds. The EDO is representing residents of Gwandalan and Catherine Hill Bay in their legal challenge to the development approval. 22. Northern Star: Stink over chicken poo (20 June 2009)
This article reports on concerns from residents of Lismore regarding a development application for a chicken manure storage facility. Nat-Grow owner David Thomas has allegedly been operating a manure facility on the site for about 12 years. EDO Northern Rivers Solicitor Sue Higginson is quoted in the article, bringing attention to environmental implications of the development application to Lismore Council.

23. Northern Star: Rally given green light (24 June 2009)
This article reports that the Repco Rally, to be held in the Kyogle and Tweed Shires has been approved in the Motor Sports Act 2009, which passed through Parliament on Tuesday evening. The Act effectively removes the need for a development application, however Kyogle and Tweed Councils are still hoping to have some input into the assessment and review of the event.

24. ABC Local Radio: Repco Rally Australia (25, 26 June 2009)

25. Northern Rivers Echo: Fowl stench brewing at Tatham (25 June 2009)
This article reports on resident opposition to the lodging of a development application by a Lismore farmer to store up to 16,000 cubic metres of manure from local chicken farms at a property at Tatham. 30. Young NELA launch
The Young National Environmental Law Association of Australia (NELA) would like to invite you to attend its NSW launch. His Honour Justice Brian Preston, Chief Judge of the Land & Environment Court will deliver an opening address at the launch. The opening address will be followed by an evening of drinks, canapés and networking. Young NELA is a committee of the National Environmental Law Association of Australia (NELA). Young NELA is focused on serving the interests of young practitioners and students in law, planning, natural resources, environmental engineering, environmental management, environmental science, environmental impact assessment and any other profession involved in the environment at a national level.

31. Funding for Hawkesbury Nepean landholders
Hawkesbury Nepean Catchment Management Authority (CMA) are offering environment conservation and heritage grants to provide funding for activities including weed and erosion control, planting local native species, bush regeneration, installing off-river stock watering systems and others. Landholders will also receive a free site visit, technical advice and help to design a project that best meets their property's needs. Landholders can either complete the on-line form to register their interest or phone their local CMA office to talk to a project officer. To be eligible, landholders' properties must be in the Hawkesbury Nepean catchment.

32. Fundraiser for Climate Camp Court Appeal
Remember the Camp for Climate Action in Newcastle in July 2008? Six climate activists arrested at Climate Camp are facing Newcastle Local Court on July 29, and will argue we need real action on climate change. 33. PowerShift 2009
Power Shift is Australia 's first national youth climate summit. It's the moment where our fast-growing youth movement for a safe climate future comes together. Power Shift 2009 will leverage the momentum the Australian Youth Climate Coalition (AYCC) member groups - all of Australia 's biggest youth organisations - have built through their various programs and campaigns. We're taking our movement beyond our schools, campuses and youth organisations to Sydney to demand - and create - a power shift to renewable energy, green jobs and safe climate future.
Look out for the EDO stall at Powershift. EDO solicitors will also be participating in panels and presenting workshops.

The International Association of Hydrogeologists (IAH) would like to invite you to attend this event, prompted by a great deal of recent activity at an investigation and policy level that is happening within the Sydney basin due to drought and conflicting water uses. 35. Hungry for Change: Shaping food policies that are fair and sustainable
This free public forum, hosted by Sydney Food Fairness Alliance, City of Sydney, Randwick, Waverley and Woollahra Councils, TransitionSydney and NSW Early Childcare Environmental Education Network, seeks participation to elicit ideas on making Sydney's food system ecologically sustainable, socially equitable and maintaining its economic viability.
Michael Shuman, US economist, attorney and champion of locally owned business and local economic development, will be the keynote speaker at Hungry for Change. Shuman will address the potential of local business and its relevance to the food security and food industry within specific regions.

36. UNSW Course: Carbon Footprinting for your product, your firm, your future
Are you interested in calculating the size of your organisation's overall carbon footprint, or that of a particular product or service? Would you like to find out more about life cycle assessment methodology, which forms the basis for carbon footprinting and greenhouse gas accounting? This University of NSW course provides an ideal background to environmental managers, business managers, engineers, researchers, analysts, environmental consultants and other industry and government decision-makers who will be required to report their greenhouse gas emissions under the National Greenhouse and Energy Reporting Act or who are preparing to provide carbon footprints for their products.
