2. FREE EDO Workshop: Coastal Development, LEPs and Advocacy - Ourimbah
This workshop will look at how planning decisions are made and how they affect coastal communities, with a focus on the Local Environmental Plan (LEP) process. With Central Coast Councils currently preparing new LEPs, this is an excellent opportunity to find out how to effectively engage in the environmental decision-making process.

3. FREE EDO Seminar: Reporting Back on the Climate Action Summit
From 31st January - 3rd February 2009, community climate action groups from across Australia came together in Canberra to discuss ways to make the community climate movement in Australia more effective and more coherent, and to help set the agenda for the second year of the Rudd Government.

If you missed the Climate Action Summit, this is your chance to find out what happened from some of the key players. Discussion will focus on the key recommendations emerging from the plenary session. There will also be a showcase of community climate action networks.

4. Private Conservation workshop (EDO Northern Rivers)
The EDO Northern Rivers office invites you to this free workshop for landowners in the Lower Clarence Valley interested in conserving biodiversity on their property. The Northern Rivers is a national biodiversity hotspot, but much of the high conservation value land is on private property. Governments and other organisations have recognised the need to protect biodiversity on private land by offering a range of formal and informal agreements and incentives.

The morning session of this one day workshop will be held in Grafton. It will cover the options for conservation agreements, with talks from EDO lawyers and staff from the Nature Conservation Trust of NSW, the NSW Department of Environment and Climate Change and the Northern Rivers Catchment Management Authority. The afternoon session will involve a visit to a farm 28 kms south of Grafton that has had a Voluntary Conservation Agreement for many years, to show how it has worked in practice.

5. Rural Landholders Workshop: Albury Wodonga NSW
The Environmental Defender's Office would like to invite you to this FREE afternoon workshop on land and water law applicable to rural landholders and relevant organisations in NSW. The workshop is taking place in conjunction with the release of the latest edition of an EDO publication, the ‘Rural Landholder's Guide to Environmental Law in NSW'. The workshop will address the legal rights and obligations of landholders and ways to manage rural land in accordance with natural resource management law. Vegetation and water management, pests and weeds, and the use of agricultural chemicals will also be discussed.

The new edition of the Rural Landholder's Guide to Environmental Law in NSW, a publication last produced by the EDO in 2006, is now available for free, including postage and handling. The guide is a valuable tool in understanding the law in NSW regarding land management and explains legislation dealing with issues such as vegetation management, protected species, fire management, water management, construction and development, pollution, agricultural chemicals, crops and stock, mining and quarrying, heritage protection, conservation on private land and trading and offsetting agreements.

7. Garrett v Freeman (No. 5); Garrett v Port Macquarie Hastings Council; Carter v Port Macquarie Hastings Council [2009] NSWLEC 1
In the recent decision of Garrett v Freeman (No. 5) the NSW Land and Environment Court sentenced Port-Macquarie Hastings Council in its corporate capacity, and a Council Director responsible in his individual capacity for offences under the National Parks & Wildlife Act 1974 (NP&W Act) and the Fisheries Management Act 1994 (FM Act).

The proceedings related to the construction of road works through an area known to be the habitat of three threatened species, including the Grass Owl and Eastern Chestnut Mouse. The road works were deemed reclamation work and were carried out without the required consent under the FM Act. The construction effectively raised the level of the area to the point where it could no longer sustain typical wetland vegetation, and subsequently damaged a fish habitat. 

In sentencing, Justice Lloyd noted that there is a clear need to uphold provisions under the NP&W Act that are designed to protect biological diversity and the habitat of threatened species. While knowledge that the area was the habitat of a threatened species is essential to the offence, the fact that the Council Director deliberately engaged in conduct that degraded the habitat served as an aggravating factor. The failure to receive proper training or instruction in regulatory standards and statutory obligations was not sufficient to excuse the Director's conduct.

Justice Lloyd also adopted a broad concept of ‘damage' to the habitat of a threatened species, which he found to include any manner of activity that serves to impair or injure the environment and its functioning, rendering it less valuable to the threatened species. The Director was ordered to pay a fine totaling $57,000 and council was required to pay a total of $46,550, plus costs for the three offences under the NP & W Act. A further $35,000 plus costs was payable by the council for the offence under the FM Act. The fact that the council, following the events, adopted a remediation and regeneration program for the area, served to significantly discount the fine.

8. Director-General of the Department of Environment and Climate Change v Hudson [2009] NSWLEC 4 (11 February 2009)
The Director-General of the NSW Department of Environment and Climate Change brought proceedings against the defendant, John Ross Hudson in the Land and Environment Court for contraventions under the Native Vegetation Act 2003 (the Act).

Two charges were brought:

1. That the defendant, contrary to s 12 of the Act, authorised the clearing of 486 hectares of native vegetation without first obtaining development consent and without a property vegetation plan authorising the clearing.
2. That the defendant also contravened s 36(4) of the Act in that he, without reasonable excuse, failed to comply with a notice issued under s 36(2) of the Act.

Justice Lloyd found in favour of the prosecution on both charges. It was held that the ‘objective seriousness and gravity of the offence' is the primary consideration in sentencing. Justice Lloyd found that this case was in the ‘upper range of seriousness' and after consideration of the maximum of $1.1 million he issued a fine of $400,000 for the first offence.

After providing no excuse as to the second charge, Mr Hudson was fined an additional $8,000.

Mr Hudson is to pay the total sum of $408 000 plus prosecution costs.

9. Hawkesbury City Council v Johnson; Hawkesbury City Council v Johnson Property Group Pty Limited (No 2) [2009] NSWLEC 6
In this case, the Land and Environment Court found Johnson Property Group Pty Ltd and its sole director guilty of an offence under the Environmental Planning and Assessment Act 1979, for clearing of vegetation without the permission of Hawkesbury City Council. The individual defendant (Mr Johnson) had engaged a contractor on behalf of the second defendant, Johnson Property Group Pty Ltd of which he is also the sole director. The offences related to the same incident, the felling or clearing of approximately 200 native plants (mostly Black Wattle (Acacia parramattensis)).  

The defendants argued that they had acted in reliance on legal advice obtained prior to the event and that the sentence should be mitigated. The court found that while legal advice was sought and relied upon by the defendants on a matter related to the charge, the defendants made minor and belated attempts to contact the council and confirm that development consent was not necessary, and acted recklessly in the commission of the offence.

Although no aggravating factors were present and the amount of environmental harm caused was minimal, the number and size of many of the removed trees meant that the offence was more than trivial, particularly given the defendants were property developers working in close contact with planning laws. While the good character of the individual defendant was considered in sentencing, he was fined $15,000 and the company was fined $19,000. The defendants were also required to pay costs of $148,000.

10. NSW Supreme Court finds development applications a TPA-free zone
In the decision Street v Luna Park Sydney Pty Ltd [2009] NSWSC 1, handed down last week, the NSW Supreme Court held that the provisions of the Trade Practices Act (Cth) 1974 dealing with misleading and deceptive statements will not apply to development applications. The court additionally found that developers do not owe a duty of care to avoid foreseeable risk of economic loss caused by inaccurate statements in development applications, to potential purchasers or developers of adjoining land.

12. Senate Inquiry into the investment of Commonwealth and State funds in public passenger transport infrastructure and services
On 4 December 2008 the Senate referred to the Rural and Regional Affairs and Transport Committee for inquiry and report by 18 June 2009, the matter of Commonwealth and State investment in public passenger transport infrastructure. The following terms of reference were provided:

• an audit of the state of public passenger transport in Australia;
• current and historical levels of public investment in private vehicle and public passenger transport services and infrastructure;
• an assessment of the benefits of public passenger transport, including integration with bicycle and pedestrian initiatives;
• measures by which the Commonwealth Government could facilitate improvement in public passenger transport services and infrastructure;
• the role of Commonwealth Government legislation, taxation, subsidies, policies and other mechanisms that either discourage or encourage public passenger transport; and
• best practice international examples of public passenger transport services and infrastructure.

13. Statutory review of the National Parks and Wildlife Regulation 2002
A new Regulation has been drafted to replace the existing Regulation which governs various activities under the National Parks and Wildlife Act 1974

The proposed National Parks and Wildlife Regulation 2009 will replace the former 2002 Regulation which will be automatically repealed on 1 September 2009.While the majority of clauses in the 2002 Regulation will be retained, there are some amendments and additions.

The proposed Regulation, along with a Regulatory Impact Statement, is on public exhibition until 27 March 2009. Copies of the Regulation and a Factsheet are available at www.environment.nsw.gov.au/consult/DecPublicConsultation.htm  

The EDO has been invited to make a submission.
 
14. National Human Rights Consultation
In December 2008, the Federal Government launched a national public consultation about the legal recognition and protection of human rights and responsibilities in Australia. The National Human Rights Consultation is an historic opportunity for individuals and communities throughout Australia to improve democracy and to have a say about the protection of fundamental values such as freedom, respect, and dignity.

The Human Rights Law Resource Centre has produced a comprehensive report to enable individuals and organisations to participate in the National Human Rights Consultation in an informed and evidence-based way. It is intended to provide important background information for those seeking to engage in the consultation.

•  Australia's future tax system – Consultation Paper
The Australian Government is currently conducting a review of Australia's tax system. The Australia's Future Tax System Review Panel released a consultation paper on 11 December, providing the basis for further community input into 2009. This paper can be found here:

Section 13 of the consultation paper seeks submissions on tax transfer impacts on the environment, the ways that taxes can improve environmental amenity and how the tax system can detract from environmental outcomes.  Submissions are due on Friday 1 May 2009.

•  National Carbon Offset Discussion Paper
The National Carbon Offset Standard Discussion Paper has been released by the federal Department of Climate Change.   It aims to provide guidance on what constitutes a genuine, additional voluntary offset credit, set requirements for the verification and retirement of such credits, and provide principles for calculating the emissions of an organisation, product or service which could be offset. The Department is particularly interested in any comments on the design of the standard in the context of the introduction of the Carbon Pollution Reduction Scheme.

16. Legislative Reviews
Legislation in NSW is usually reviewed after five years.  A review is carried out to determine whether the policy objectives of an Act remain valid and whether the means of addressing these objectives are appropriate.  The following Acts are shortly due for review: 

•  Native Vegetation Act 2003,
• Natural Resources Commission Act 2003,
• Catchment Management Authorities Act 2003,
and
• Threatened Species Conservation Act 1995.

18. Richmond River Sun : Iron Gates clean-up will be pursued (February 2009)
Following on from last week's media item on ABC Radio, this article reports on local environmental concerns regarding remediation work at the failed Iron Gates real estate development at Evans Head. EDO Senior Solicitor Ian Ratcliff was interviewed about the failure of Iron Gates Pty Ltd to comply with orders made by the Land and Environment Court of NSW in 1998. The EDO acted for Mr Oshlack in those proceedings.

23. Conservation Council ACT Position Vacancy: Environmental campaigner
The Conservation Council ACT Region, the peak non-government environment organisation for the ACT and Region, is looking for experienced environmental and conservation campaigners.  Current areas in which the Council is active include biodiversity conservation, climate change, sustainable planning, transport, waste management, and water.

At this stage, we are seeking expressions of interest from individuals who might be interested in applying for full or part-time positions with the Council.  The Council, once it has completed its review of staffing needs, and understands the likely availability of qualified persons, will shortly be advertising for formal applications.

At this stage the Council is not being restrictive in terms of the conditions of employment and thus, even if you are only able to work part-time, we would be interested in hearing from you.  The Council expects to offer remuneration at approx. $50,000 pa, or pro-rata.

24. EcoForum Conference and Exhibition 2009
The EcoForum conference stream aims to provide information on the kind of government support available for businesses planning to mitigate the effects of climate change. Anne Scott, Deputy State Manager in the AusIndustry NSW State Office, will tell delegates how the Climate Ready, Re-tooling for Climate Change and Green Building Fund grants programs under the new Clean Business Australia initiative can assist businesses to adapt to climate change.

The EcoForum climate change conference stream will also feature presentations from across Australia from the energy, local government, telecommunications, business, academia and environmental consulting sectors on a multitude of climate change responses, from how consumer behavior is affected and how that will affect your business to integrating climate change considerations into environmental studies.

As well as the conference stream on climate change, the Sydney EcoForum in April will feature:

25. Australian Orangutan Project: Cry From the Wild Tour NSW
The orangutans' rainforest habitat is disappearing at an overwhelming rate with the remaining forest being degraded by drought and forest fires. Extinction in the wild is likely to be 2010 for Sumatran Orangutans and 2015 for Bornean Orangutans. We need to recognise the massive amount of suffering being inflicted on a species that is 97% genetically identical to humans.

The Australian Orangutan Project supports many orangutan conservation organisations. AOP is a non profit organisation staffed by volunteers to raise funds and collect donations for Orangutan Conservation and habitat protection.

The ‘A Cry From the Wild' tour will provide a rare insight into the threatened world of the orangutan from two dedicated conservationists: Leif Cocks, President of the AOP and Hardi Batiantoro from the Centre for Orangutan Protection, Indonesia.

Climate Action Network Australia's (CANA's) annual conference is the only event where the representatives of the major community voices, including the CANA Member Organisations, come together to receive an update on new developments in the broad field of climate problems and potential solutions, collaboratively plan campaign and research strategies, and network with leading government, academic and corporate stakeholders.

In 2009, the role of the climate movement is particularly significant as major climate policies move into legislation in Australia and the United Nations Framework Convention on Climate Change prepares to meet in Copenhagen in December to develop a post-Kyoto climate agreement. For these reasons, the topic of this conference is 'The turning point'. In 2009, many non-government climate campaigns will come to fruition and revised campaign planning is required to respond to the new policy environment. The prominence of the CANA conference in 2009 is key for industry, government and academic representatives working on climate change issues.

27. Applications Available for 2009 UNU-IAS Fellowship Programme
Every year UNU-IAS offers PhD and Postdoctoral fellowships to provide young scholars and policy-makers, especially from the developing world, with a multi-disciplinarily context within which to pursue advanced research and training that is of professional interest to the successful applicant and of direct relevance to the research agenda of their selected UNU-IAS or UNU-ISP programme.

About 8-10 fellowships will be awarded in total in 2009 for three types of fellowships: PhD Fellowships, Postdoctoral Fellowships and JSPS-UNU Postdoctoral Fellowships. 

The closing date for applications is 31 March 2009 (17h00 Tokyo time) for fellowships beginning on 1 September 2009.

28. Total Environment Centre Position Vacancy: Program Support Officer, Green Capital
Green Capital ( www.greencapital.org.au ) is TEC's ( www.tec.org.au ) program focusing on reducing the environmental footprint of business – the largest and longest running business sustainability program in Australia, run by an NGO.

Our business programs are an integrated part of TEC's environment protection campaigns expanding its reach and highlighting NGO and sustainability thinking. The program is unique in that it brings together NGOs, government and businesses to advance the sustainability agenda in Australia. It undertakes research; holds major and small events to raise the profile of current issues; produces reports and policy proposals and also has a corporate training component.

TEC is seeking a person who wants to help make a difference in a job providing great satisfaction and potential for achievement in environmental sustainability.

Duties
• Maintain the Green Capital database of business contacts and event management information
• Monitor and assist with partner payments and renewals
• Process incoming and outgoing monies/invoices and liaise with the TEC Administrator
• Manage the ‘green capital' email
• Follow up on debtors
• Provide monthly budget and debtors reports
• Assist the Event Manager with logistics as required
• Participate in team discussions about topics and development of intellectual property
• Assist with the website
• Other duties as required

Preferred Experience, Attributes
• Proven experience with database and accounting software and websites
• An understanding of and experience in working for environment goals with NGOs and the business community
• A knowledge of sustainability policy, particularly as it relates to the environment, but also the social welfare sector
• Ability to work within a team

The position is a part time appointment (24hr week), with prospects for extension and the opportunity to be part of the Green Capital team providing event management, policy development, sustainability advice and fundraising.
Remuneration: $31,800 pa (24hpw) plus super and holiday leave loading.

29. Greenpeace Public Forums: GM Crops – the benefits and risks
Australia is currently at a cross-roads, with genetically modified (GM)
canola being grown for the first time last year. Before farmers can
decide whether they want to go down the GM path they need to be aware of
all the potential benefits and risks associated with GM crops. These
public forums provide an important opportunity to talk directly with
farmers from North America, where GM crops have been grown commercially
for more than a decade. Speakers will discuss issues such as benefit
gained, corporate influence, costs, segregation of GM crops, legal
concerns and the effect GM crops have had on markets:

Speakers are to include Moe Parr – a seed cleaner from the USA, Ross Murray – a third generation seed grower and grain cleaner from Canada.
